Flixfox DMCA & Intellectual Property Compliance Policy
Flixfox upholds the legal rights of film producers, broadcast networks, regional media studios, and independent creators, in India and worldwide. This policy explains how copyright complaints are handled, under the Copyright Act, 1957 of India and the principles of the Digital Millennium Copyright Act (DMCA).
An automated directory, not a host
Flixfox functions strictly as an automated indexing protocol and technical navigation utility. It maintains no content-hosting centres, no streaming server clusters, and no digital storage vaults, and it does not host, upload, archive, transcode, or distribute any media files on its own infrastructure. The system crawls, indexes, and catalogues publicly accessible links from across the open web so that viewers can locate media efficiently. As a technical intermediary with no editorial curation of, or custody over, remote content, Flixfox operates within the statutory safe-harbour protections.
Submitting a takedown notice
A copyright owner, or a representative legally authorised to act for one, who finds a link in the Flixfox index, category banners, search rankings, or fixture listings directing users to unauthorised work may submit a de-indexing notice through our official online portal. To be processed without delay, each notice must include:
- A recognisable physical or authenticated electronic signature of the individual authorised to act for the copyright owner.
- Precise identification of the infringed work, such as the film, broadcast, or sound recording, with its title, registration number, or a reference link to the authorised version.
- The exact, functional URLs or deep-link locators indexed within Flixfox that resolve to the disputed file; broad title queries, generic terms, or screenshots are not actionable.
- Full complainant credentials: legal identification, mailing address, telephone number, and official email contact.
- A good-faith statement that the disputed use is not authorised by the copyright owner, its agent, or the law.
- A declaration, under penalty of perjury, that the information supplied is accurate and that the notifier is empowered to enforce the designated rights.
Once an actionable, legally complete notice is verified, our compliance team expeditiously purges the contested locators from the search index, language filters, and discovery menus.
The reach of de-indexing
De-indexing an address within Flixfox removes the link from our directory interface, but it does not eradicate, modify, or erase the underlying file from the remote server that stores it. Because Flixfox holds no technical or administrative oversight over third-party repositories, a rights owner seeking permanent deletion from the wider internet must contact the primary website or hosting entity directly. Within its own directory, Flixfox applies removals reliably.
Counter-notification
Section 52 of the Copyright Act, 1957 preserves fair dealing, including criticism, review, news reporting, and comparable lawful uses. A party who believes a link was removed in error or by misidentification may file a counter-notification through the same portal, stating the exemption relied on, identifying the removed material and its former location, providing signature and contact details, and consenting to the jurisdiction of the courts of New Delhi or Mumbai. Where it holds and no legal proceedings begin within the statutory period, the link may be reinstated.
Repeat infringers
Flixfox enforces a graduated three-strike policy against any party that repeatedly misuses the platform or attempts to inject illegitimate locators into the indexing pipeline. The first instance brings a formal warning with the offending links removed; the second, a temporary suspension from the relevant tools; the third, permanent exclusion from the service. Conduct that is severe or plainly deceptive may reach the final stage directly, and a notice filed in knowing bad faith exposes its sender to liability rather than any advantage.
